Warranty documents

When you take delivery of your flat from the developer, you do not just receive the keys – you should also receive a full set of warranty documents and operating instructions for the installations and appliances. It is on this basis that you can report faults, make use of manufacturers' warranties and demand that defects be rectified within specified time limits. Below you will find a list of necessary documents and a practical step-by-step guide on how to proceed if you need to report defects.

1. Check the full set of documents from the developer

  • Developer warranty – a document specifying the warranty period (usually 5 years) and how to report defects.
  • Warranty cards for equipment and fittings – stamps and dates from manufacturers of heating, electrical systems, windows, elevators, etc.
  • User manuals – installation and operation instructions for boiler, heat pump, ventilation systems, household appliances and smart-home systems.
  • Energy performance certificate – confirms the energy class of the building/apartment.
  • Statement on tightness and pressure testing of plumbing and heating systems – protocol confirming that the systems were tested.
  • Handover protocol – list of defects reported at handover along with deadlines for their repair.

2. Organize your document archive

  • Create one place for paper and digital copies of each warranty card and manual.
  • Label files with the handover date and document type (e.g. “Warranty_windows.pdf”, “Manual_boiler.pdf”).

3. Initial inspection and deadline control

  • Check from which date the warranty/guarantee is valid (see handover protocol date).
  • Mark warranty expiry dates (developer and manufacturers) in your calendar.

4. Reporting defects – step by step

  • Document the issue
    • Take photos of the defective elements, noting the date and location (e.g. “2025-08-08 – leak under sink”).
  • Complaint protocol
    • Complete the developer’s complaint form or your own: describe the defect, attach photos, and refer to the warranty document you are basing the complaint on.
  • Deadline for submission
    • Developer warranty: 5 years from the date of handover.
    • Manufacturer warranties: various durations (usually 2–5 years), check the warranty card.
  • Submission method
    • Email with attached protocol and scanned warranty cards; keep confirmation of delivery and read receipt.
    • If the developer offers a client portal – upload documents there for a digital record.

5. Developer and contractor obligations

  • Acknowledge the complaint within 7 business days.
  • Fix defects according to warranty terms – usually within 30–60 days.
  • Provide written notice upon completion and schedule a follow-up handover.

6. In case of delays or refusal

  • Send a formal notice (email + registered letter) with an additional deadline (minimum 14 days).
  • Request an independent expert opinion if the developer denies the defect.
  • Seek legal or mediation support, and if needed, take legal action for substitute performance or compensation.

7. Second handover – repair acceptance

  • Once defects are fixed, arrange a follow-up handover.
  • Check if the repair aligns with the initial protocol and warranty terms.

8. Keep documentation until the end of the longest warranty

  • Retain all confirmations and protocols until the expiry of the longest warranty period.
  • This will simplify any further claims and help protect your rights.
